Accommodation bookings made through Whitebeach Holidays Limited are
governed by the following Terms and Conditions:
1. Terms of Payment
- Your contract with us will come into existence when we receive your deposit (25% of the total accommodation cost). The balance must be paid 8 weeks before your scheduled date of arrival (“arrival”). We reserve the right to regard the booking as cancelled if the balance is not received by then and will be entitled to retain any deposit paid. If the booking is made within 8 weeks of arrival full payment must be made at the time of booking and the contract between us comes into effect upon our receiving payment.
- We do not accept payment by credit or debit card.
2. Insurance
It is a condition of booking that you have comprehensive travel insurance. Except for personal injury or death caused by our negligence we cannot accept any responsibility for medical expenses, costs of repatriation, loss or damage to possessions or any other costs, losses or damages of the kind which would be covered by a travel insurance policy.
3. Costings
All costings are subject to final confirmation as on the invoice. Errors
and omissions are excepted.
4. Cancellations
Cancellation by You
Cancellation must be in writing by lead name and sent by recorded delivery to Mrs H Hart, Whitebeach Holidays Ltd, 30 Gardenia Road, Bush Hill Park, Enfield, Middlesex EN1 2HZ. Cancellation of accommodation will apply from the date of receipt by us of the written cancellation notice. If we receive the notification of cancellation more than 56 days before arrival, only the deposit will be retained. If less than 56 days then the following cancellation charges will apply:
- 43-56 days before arrival 40% of the total cost
- 29-42 days before arrival 60% of the total cost
- 15-28 days before arrival 80% of the total cost
- 14 days or less before arrival 100% of the total cost
If you are covered by holiday insurance you may be able to recover
these cancellation charges.
Cancellation by Us
In the very unlikely event that specific accommodation ceases to be available as booked and we are unable to offer you equivalent alternative accommodation we will refund you all the money paid (including the deposit) but no other compensation. If we cancel due to non-payment of monies or other breach by you, the above charges shall apply from the date of cancellation by us.
Force Majeure
If cancellation or change by us is brought about by war, threats of war, riots, civil commotion, strikes, disasters, terrorist activities, bad weather, acts of any government or public authority, acts of God or other events outside our control we shall not be held responsible in any way, except to refund any monies already paid in the event of cancellation.
5. Complaints
- It should be noted that we act only as agents to arrange the booking on behalf of the owner of the booked property and therefore, except for death or personal injury caused by our negligence we cannot accept responsibility for the condition of the accommodation or for any other loss or damage suffered.
- We will do our best to help resolve your justifiable complaints regarding the accommodation. In the event of a complaint you should complain immediately to our management company, Freedom Properties SL (and if your complaint is not resolved you should complete a Report Form available from Freedom Properties SL, keeping a copy for yourself). If the matter is still not resolved to your satisfaction, you should write by registered post to Mrs H Hart, WhiteBeach Holidays Ltd, within 10 days of leaving the accommodation.
6. Property Damage
Should any furnishings or fittings in the accommodation be lost or damaged you will be required to make immediate cash settlement with Freedom Properties SL for any necessary replacement or repair.
7. Changes
If, after the contract comes into effect, you wish to change any details of the booking (e.g. arrival date or accommodation) we will endeavour to comply. A fee of £20 per person will be charged for each amendment. In the event that 56 days before arrival you wish to alter your arrival date the cancellation charges will apply.
8. Third Parties
We do not offer flights and the contract for your flights will therefore be between you and the airline or agent rather than with us and will be governed by the terms and conditions of the particular airline or agent.
9. Miscellaneous
- The maximum number of people occupying the accommodation must not exceed the number of people specified on the booking form.
- Each property is different in style and its facilities will vary depending on the owner, but all properties meet our general standard with regard to basic amenities. Photographs on our website and in our marketing literature are only samples of the carried selection of properties we offer.
- We reserve the right to terminate your holiday due to misconduct by you or of anyone in your party.
- Waiver or delay by us to enforce any provision of the contract shall not be construed as a waiver of any of our rights under the contract.
- Except as expressly provided otherwise the parties do not intend any term of the contract to be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999.
- Satellite television, water, gas and electricity supplies can sometimes be interrupted.
- These Terms and Conditions shall be governed by and construed in accordance with English Laws and you agree to submit to the non-exclusive jurisdiction of the English Courts.
